Terms of Service

1. Agreement to Terms

By installing or using any application ("App") provided by Hammer Forge Apps, operated by Thrifties LLC ("we," "us," or "our"), you ("Merchant" or "you") agree to be bound by these Terms of Service. If you do not agree, do not install or use the App.

2. Service Description

Hammer Forge Apps develops and provides Shopify applications. Our current Apps include:

  • LabLinks - COA Lab Report Link: An application that allows Shopify merchants to upload lab test reports (Certificates of Analysis) and link them to their Shopify products for customer-facing display.

3. Eligibility

You must have an active Shopify store and be authorized to install applications on behalf of that store. You must be at least 18 years of age.

4. Account & Access

Access to our Apps is provided through your Shopify account via Shopify's OAuth authentication system. You are responsible for maintaining the security of your Shopify account credentials.

5. Billing & Payments

5.1 Pricing

Our Apps offer tiered pricing plans as described on the App listing and our website. Prices are in US Dollars (USD).

5.2 Billing Through Shopify

All charges are processed through Shopify's billing system and appear on your Shopify invoice. We do not directly collect payment information.

5.3 Free Trials

Paid plans may include a free trial period. Free trials are available to first-time subscribers only. One free trial per store, per plan.

5.4 Cancellation

You may cancel your subscription at any time by uninstalling the App from your Shopify admin. Cancellation takes effect at the end of your current billing period.

5.5 Refunds

Refunds are handled in accordance with Shopify's refund policies for app charges. Contact us if you believe you are entitled to a refund.

6. Acceptable Use

You agree not to:

  • Use the App for any illegal purpose or in violation of any laws
  • Upload fraudulent, falsified, or misleading lab reports
  • Attempt to reverse engineer, decompile, or hack the App
  • Use the App to infringe on intellectual property rights of others
  • Exceed reasonable usage limits or abuse the service in a way that degrades performance for other users
  • Resell, redistribute, or sublicense access to the App

7. Your Content

You retain ownership of all content you upload to the App, including lab test reports, images, and data. By uploading content, you grant us a limited license to store, process, and display that content as necessary to provide the App's functionality.

You represent and warrant that you have the right to upload and display all content you submit, and that such content does not violate any third-party rights.

8. Intellectual Property

The App, including its code, design, branding, and documentation, is owned by Thrifties LLC and is protected by intellectual property laws. You may not copy, modify, or distribute any part of the App without our written permission.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, or completely secure. We do not verify the accuracy or authenticity of lab reports uploaded by merchants.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THRIFTIES LLC AND ITS OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE APP.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE APP SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless Thrifties LLC from any claims, damages, or expenses arising from your use of the App, your content, or your violation of these Terms.

12. Data & Privacy

Our collection and use of your information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

13. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

Upon termination, your right to use the App ceases immediately. Data deletion follows the process outlined in our Privacy Policy.

14. Changes to Terms

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the updated Terms. We will notify merchants of material changes via email.

15. Governing Law

These Terms are governed by the laws of the State of Minnesota, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Hennepin County, Minnesota.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
